Vicarious Liability in the Law of Agency?

Abstract

A good number of cases adopt vicarious liability reasoning to impose liability or consequences on a principal for the acts of an “agent”, agency here being understood broadly and liberally. This is difficult to justify in agency and tort law as traditionally understood. This article is an attempt to formulate an understanding of the cases in the hope that the law can be developed in a sensible and principled manner. © 2022 Thomson Reuters and Contributors.
