Abstract

以YouTube为主的音视频内容分享平台,近年来纷纷采用“在先许可”模式与众多版 权方开展合作,用户通过在先许可协议可以在平台内大量使用版权所有的内容而不用事先获得授权,而版权方则可通过间接培养产品市场、增强用户忠诚度、股份或者广告收益共享等方式获益。在先许可协议在促进市场融合、减少版权纠纷方面有极大优势,但目前也存在许多不足。我国应当在借鉴国 外先进经验解决版权僵局、构建“数字版权生态系统”以及完善我国版权法律体系的同时,避免其存 在的缺陷。
Many audiovisual sharing platforms like YouTube are using the so-called "Pre-License" Agreements to cooperate with copyright owners. Platform users can use massive copyrighted contents within the platform under the agreement without individual license, and copyright owners could monetize these uses through royalties, company stakes, or advertisement revenue share. These "Pre-License" Agreements have advantages in market merging and development, but they also have some disadvantages. When introducing the "Pre-License" Agreement to settle the copyright dilemma, to form our digital copyright ecosystem, to optimize our copyright system in China, we must be aware of its flaws.
