Abstract

The varied understandings of, and approaches to, criminal responsibility in relation to children are explored in this chapter. It finds that these differences are often not clearly acknowledged or articulated but they fundamentally shape debates about the minimum age level of criminal responsibility. In unravelling these differences, this chapter allows for a better understanding of the implications that these conceptualisations have for arguments about how the law does and should deal with children who transgress the criminal law. The chapter concludes by making recommendations about how the law ought to address the criminal responsibility of children. © 2024 Informa UK Limited
