Abstract

Discusses significant policy changes since Hazell v Hammersmith and Fulham LBC (HL) in respect of whether a local authority has the legal capacity to enter swap derivative transactions under the ISDA 2002 Master Agreement. Explains the relevant shift in capacity, and the applicable remedies.
