Constitutional Foundation of CSR: From Theoretical Justification to Judicialization

Abstract

Assuming corporate social responsibility (CSR) an evolving idea in business governance, the discourse has been monopolized by ethno-corporatist and some selective sustainable discourses. Appearing beyond the traditional test of CSR, this idea postulates to be examined by the legal creeds where the constitutional foundation can be the most appealing one. Convinced with such apprehension, CSR, throughout this research, has been examined with the components of constitutional narrative. Amidst, natural law theory that constructs the underpinning of constitutionalism, and other constitutional facets inter alia constitutional directives, fundamental rights and constitutional review have been wielded here to defend the constitutional foundational of CSR ranging from theory to judicialization.
