Abstract
In the recent Supreme Court case Philipp v Barclays Bank UK Plc (Philipp v Barclays), Lord Leggatt has ironed out the long misconceived Quincecare Duty being a conflicting duty to the bank’s other general duties is nothing more than a subordinate (non-independent duty) and a general duty to enquire on reasonable ground for believing that the agent of its customer was attempting to defraud the customer.
