Abstract
西夏歷代統治者著力利用絲路來獲取最大的利益，以鞏固其統治及爭取外交籌碼。但由於西夏長期與東邊的遼、宋戰爭，和、戰不斷致使西夏利用絲路的貿易處於頗為尷尬的位置，特別是當戰爭時期周邊的大國關閉榷場時，西夏在官方層面主導轉手貿易便無法通行於東亞國家。然而，民間商品市場卻不能停止，於是民間走私貿易就大行其道。本文以西夏法典有關防禁走私的條文審視當時西夏與宋王朝之間非法走私活動的情況。
