Abstract

Healthcare has been seen as an early candidate to be revolutionized by artificial intelligence (AI) technologies.  The application has a compelling prospect in the healthcare sector.  However, a number of legal issues have been raised by the use of AI in healthcare, such as the legal status of AI, product liability, personal data security and privacy protection, and intellectual property concerns.  Moreover, new regulatory challenges have been brought about as regards healthcare AI technologies.  Based upon the unique properties and risks inherent to AI technologies, this article comprehensively discusses the above legal issues and regulatory challenges in the light of the current law of China as well as by reference to foreign regulations relevant to healthcare AI technologies.
