Abstract
This paper, written in Chinese, examines the rules on formation of contracts in various jurisdictions including U.S., UK, Germany, France and China, as well as in international sales law, and discuss the implications of those rules on contract formation in international trade. Its focus is the so-called "battle of the forms" in international sale of goods.
