A Common Law Approach to Hong Kong's Constitutional Order under "One Country, Two Systems"

Description
Given that it has been officially claimed in Xi Jinping's Speech on I 2022 that the "One Country, Two Systems" (OCTS) framework will remain unchanged after 2047 and continue to apply to Hong Kong, it is intellectually desirable to theorise the implementation of the Hong Kong Basic Law (BL) under the OCTS. This project aims to explore theories and doctrines on how to interpret the BL under a common law approach, given the anticipated continuity of OCTS and the national security regime entailed therein. It will examine how the BL should be interpreted to ensure that the implementation of NSL will harmonise with Hong Kong's common-law-based rule of law order. In addition, it will explore the question of how to consolidate the inclusiveness and the diversity of Hong Kong's rule of law order, given that Hong Kong plays the unique global role in Asia.Detail(s)
